Why I Limit the Time Slots Available
While I use the TorrentLawyer Blog as an educational resource for our readers (usually those accused of infringing the copyright rights belonging to a copyright holder that we are representing clients against), we are also a law firm.
As the founder of the Cashman Law Firm, PLLC, I keep the calendar open for new inquiries ONLY when we are taking new clients in the law firm (we manage the inflow of clients and ONLY take clients when we can properly represent them). We are not a volume-based law firm, as I have written about many times, and I do not represent tens or hundreds of clients with one phone call or e-mail.
For this reason, you will notice that I do limit the number of potential clients our law firm has at any one point. I also limit the number of time slots I make available on our 3rd party appointment site (https://torrentlawyer.as.me/), sometimes making no appointments available on a particular day, or for days at a time.
I will still speak to you, even if no phone consultation time slots are available.
If there are no phone consultations or available time slots available, this does not mean that I will not speak to you — I have spent literally thousands of hours taking calls over the last fourteen years helping tens-of-thousands of John Doe Defendants of all kinds, most of the time knowing that they will not end up being my client. I still take the call (time permitting), and I will continue to happily arrange to speak to you if you need my assistance.
If there are no available time slots available, and you still would like to speak with me, please e-mail me at urgent@cashmanlawfirm.com.
Why I do not have secretaries or members of my staff answering the phones.
Again, we are a law firm. In past years, I have had my staff answer phones in the past, even designating one or two people to manage the incoming calls.
However, the specialization of our law firm is pre-trial defense strategies for accused internet users who are accused of downloading, viewing, copying, or using copyrighted videos or software without a license. As such, the lawsuits they find themselves in are usually something called “John Doe” Lawsuits, where there are sometimes 100+ accused “John Doe” Defendants who are sued at the same time in the same lawsuit. As such, they all receive the same ISP letters from their internet service providers at the same time, and sometimes, with the same deadlines as everyone else implicated in the same lawsuit.
Thus, our phones might be quiet, and then all of a sudden, 200+ people are trying to reach me at the same time. This happens quite frequently, especially with the software piracy lawsuits.
This is relevant to you because every one of the callers wants to know the same thing.
Questions almost every incoming call wants answered.
- What is the subpoena that I just received from my internet service provider?
- What do I do with the subpoena? Am I supposed to file a motion to quash or some kind of opposition with the court [to prevent my ISP from sharing my identity with those that sued me]?
- If I did do the downloading of the movie (or if I did use the copyrighted software without a license), do I need to settle the claims against me? If so, how much will this cost?
- If I did not do the downloading, or if I was not the one who pirated the software, what are my defenses? Must I go through litigation to defend myself? Or is there an easier way to handle this?
- I want to settle the claims against me, what happens if I cannot afford the settlement numbers they will be asking for? OR,
- I want to settle the claims against me, but what if I have a lot of money in my bank account? Will I have to disclose my personal financial information to those that sued me?
Each of these questions are VERY GOOD questions, and they are immediate and need a personalized answer.
Why I no longer have my staff answer these questions.
Ethically, [even though I know other attorneys do this,] I cannot have a non-lawyer answering these questions. I also cannot have one of my staff advising those on the phone what their options are. This comprises “legal advice,” and I am responsible for everything said to a potential client. I am not only responsible and liable for what I say to people on the phone, but I am also responsible and liable for what those of my staff say to people on the phone.
Again, I have trained members of my staff to answer questions WITHOUT giving legal advice in the past. They were able to speak generally about the case, and they knew what they were permitted to say, and what they were not permitted to say.
However, as correct as my instructions were in theory, IN PRACTICE, it was very difficult for them to take an incoming call and NOT give legal advice. For this reason, ONLY I answer the phones now, and if I am in court, or if I am in a meeting, I ask those that call to set up a phone consultation or e-mail me at info@cashmanlawfim.com.
Will I take every person that calls as a client?
No. You can read about this here (you should take a moment and read this).
In sum, this page was supposed to automatically forward you to our Cashman Law Firm’s Phone Consultation Scheduling Page. But obviously, I know it didn’t, and you are still here. I hope you benefitted from learning a bit more about me (Rob Cashman), our Cashman Law Firm, PLLC, and my philosophy as far as when I take calls and when I do not, (and if you visited the above link, when I take clients, and I when I do not).
