CULPEPPER IP has figured out a way to enforce his movie clients’ copyrights out-of-court. He has done this by sending settlement demand e-mails to internet users accused of VISITING, REGISTERING (with their real e-mail address), and DOWNLOADING copyrighted movies from the YTS website.

These settlement demand letters have been sent *via e-mail* by attorneys working for Kerry Culpepper of Culpepper IP. His attorneys are also the names which are appearing on many of the Culpepper IP settlement demand letters sent directly to internet users… without an ISP subpoena, without a Hawaii Rule 512(h) subpoena, without asking Cloudfront or Google Analytics to hand over the IP address information, and without a copyright infringement lawsuit in the Hawaii District Court.

The reason I am mentioning the Culpepper IP settlement demand e-mails here [in this article] is because with Kerry Culpepper, YOU MUST BE PREPARED that there is SOMETHING ELSE going on behind the scenes.

Expect to be asked to pay multiple settlements for multiple movies downloaded.

Be warned that settling the Fallen Productions Inc. (or HB Productions Inc.) ISP subpoena-based lawsuits might result in Kerry Culpepper of Culpepper IP asking you to pay for additional settlements for other movies your accused IP address downloaded on other dates using bittorrent.

[Also be warned that if you hire a “settlement factory” defense attorney, chances are high that in their attempt to streamline the settlement process, you will not only pay a settlement for the “Angel Has Fallen” movie (or the “Hellboy” movie, or whatever movie is behind that particular copyright infringement lawsuit), but you may also end up having to pay for EACH AND EVERY OTHER MOVIE you may have downloaded over the past few years (assuming “tongue-in-cheek” for a moment that this same plaintiff attorney is representing the other movie companies as well).]

How is it that Kerry Culpepper of Culpepper IP is the same attorney representing ALL the movie lawsuits?

Now obviously Kerry Culpepper is only one attorney in Hawaii. There have been *MANY* attorneys over the past ten years which I consider to be copyright troll attorneys who represent the same set of clients. However, in the past few days / weeks, Kerry Culpepper of Culpepper IP started a storm of activity on the web by going after YTS / 1337x.to — the bittorrent trackers and the piracy websites themselves.

Then, he followed this up be asking the court for a subpoena to disclose the identity of accused downloaders who used those website to download his client’s movies.

…Then, Kerry Culpepper sent DMCA settlement demand letters to these accused downloaders asking them to settle the claims against them for $1,000 per movie download or face a copyright infringement lawsuit in the federal courts. Thus, I am using Kerry Culpepper of Culpepper IP as the example in this article about his client — a COMMON MOVIE TROLL entity.

Have you heard? There is STILL a COMMON COPYRIGHT TROLL entity behind all of the movie lawsuits in the US.

I am about to claim (again, 3 years later) that the same set of attorneys (here, Kerry Culpepper of Culpepper IP) are behind ALL of the movie lawsuits filed in the US (and that each of these attorneys are working for the same common copyright troll entity), and I have proof.

In 2017, I spent a lot of time making known that the movie-based bittorrent cases were all being run by the same people behind the scenes. It was too coincidental that the same “copyright troll” attorneys were attracting every single movie company to be “their” client. 

For years, I had only anecdotal evidence that the same attorneys were representing the same set of movie companies. It was only here in this lawsuit [All the movie companies together (represented by Kerry Culpepper of Culpepper IP) v. Harry Beasor and DOE (Case No. 1:20-cv-00004) in the Hawaii District Court] that I had demonstrable proof that one attorney was representing EACH AND EVERY ONE of the movie copyright trolls.

[Initially, I could explain this theory away by thinking that it is more plausible that there is a large entity who moves within the circles of the large movie producers and has the ear of the production companies.  Thus, when there is (yet) a(nother) movie that flops, they suggest that this movie production company use their services and sue downloaders of the film to re-coup losses from their failed movie.  At one point, I thought it was the MPAA itself which was the entity behind the scenes.  Within the context of this “bigger” entity, the plaintiff attorneys filing the lawsuits in each state are merely “cogs” in the wheel of this larger entity.]

One Explanation: ONE attorney in each state works for the same COMMON COPYRIGHT TROLL entity.

Let’s elaborate using logic.  If ONE plaintiff attorney in one particular state has become the ONLY ATTORNEY who files ALL of the movie lawsuits, then this plaintiff attorney must either be a MARKETING GENIUS by achieving this monopoly (meaning, the plaintiff attorney is 100% successful in attracting every one of the new movie lawsuits AND has been 100% successful in excluding EVERY OTHER ATTORNEY from filing movie lawsuits in that particular state)…

…Or (more likely,) there are a group of insiders or [there is] a single entity behind the scenes [with a reputation among the movie production companies] which actively sells their services to each of the movie companies — [offering to sue every downloader for copyright infringement].

Each attorney filing in each state’s federal court is working for this same “common copyright troll” entity which provides them with the instructions to sue defendants accused of downloading their client’s copyrighted movie titles. 

My observation: The same movie companies are always represented by the SAME copyright troll attorneys in each state.

Based on my observations over the years, the SAME plaintiff attorneys represent the SAME movie companies in EVERY STATE.

With this case (pictured above), I can demonstrate that in the Hawaii District Court, Kerry Culpepper of Culpepper IP is the attorney that is representing each and every one of the movie lawsuits.

In other words, just as Kerry Culpepper of Culpepper IP is the “copyright troll movie attorney” in Hawaii, there are other plaintiff attorneys in other states who are working for a common copyright troll entity working behind the scenes. 

Who is this COMMON COPYRIGHT TROLL entity?

But who is this common copyright troll entity?  Thinking logically that the MPAA is too-big-of-an-entity to cause such mischief, after some searching, in 2017, I found a company named “Rights Enforcement” (found at RightsEnforcement.com) being run by “Carl Crowell, a one-man police force for Hollywood studios.

It was further proof at the time that there was a copyright troll [at the time, Carl Crowell, owner of RightsEnforcement.com (RightsEnforcement website *now taken down or changed to some other name I am not yet aware of*)] who was [at the time] posting each of the movies on their websites only to have those exact movies be the movies that were used to sue accused downloaders across the US.Below is an image taken from the now defunct RightsEnforcement.com website:

NOTE: It appears to me that Rights Enforcement (purposefully named to be an impossible name to find on a Google Search) was the website that was used to sell Carl Crowell’s “Hire us and we’ll sue [for you] internet users who have downloaded your copyrighted films.” The RightsEnforcement.com website’s last update was in July, 2017 when they updated the list of movies.

RightsEnforcement.com has since been removed and their domain abandoned.

You might think this means that they went out of business, but really, based on my own research, it appears as if they did not want people to be aware of their activities. In other words, the RightsEnforcement.com website was meant to be hidden from people like you and me, and our articles brought too much exposure to what they were doing.

As you can see below, Carl Crowell and RightsEnforcement.com even took steps to hide their footsteps by excluding their website history from archive.org’s “Way Back Machine.”

Why I think that HB Productions & Fallen Productions, Inc. are part of this “common copyright troll” conglomerate entity.

Returning to the HB Productions, Inc. (“Hellboy”) and Fallen Productions, Inc. (“Angel Has Fallen”) lawsuits, I have reason to believe that these two “shell” production companies are yet TWO MORE companies affiliated with Carl Crowell, Rights Enforcement (whatever name they go by now), and Guardaley (the German entity probably behind even Carl Crowell).

As you can see, these two copyright trolls are represented in this lawsuit image above by Kerry Culpepper of Culpepper IP.

When I first saw this, I was surprised to see that so many of the “common copyright troll” entity’s clients showed up as co-plaintiffs… suing TOGETHER in ONE copyright infringement lawsuit…

But then when I immediately saw that this was filed in the US DISTRICT COURT… FOR THE DISTRICT OF *HAWAII*, my immediate thought was that “Kerry Culpepper of Culpepper IP must have been the one who filed this.” Only he would have the strategic calculations that would inspire him to bunch these lawsuits plaintiffs together.

“Kerry Culpepper of Culpepper IP” in Hawaii must have been the one who sued these defendants for all of his client’s movies (including HB Productions Inc. & Fallen Productions Inc.).

In sum, call this all a conspiracy theory, but then notice which copyright holders have just sued defendants TOGETHER IN ONE LAWSUIT filed by Kerry Culpepper in the Hawaii District Court:

Have Movie Companies Taken a Lesson [to ask for multiple settlements] from the Porn Industry Strike 3 Holdings LLC & Malibu Media LLC Lawsuits?

Strike 3 Holdings LLC and Malibu Media LLC (both pornography-based lawsuits) found a way to force accused adult film downloaders to not only settle the claims against them for one copyrighted movie downloaded, but in every lawsuit, they now ask for settlements for each and every copyrighted title ever downloaded by that internet user.

How many times are YOU willing to settle the claims against you?

In sum, unlike Kerry Culpepper of Culpepper IP, most plaintiff attorneys have been trying to hide on the court’s dockets that they are suing for one video, but asking for settlements for other titles allegedly downloaded by that same downloader. I don’t even need to breach this topic, but settlement factory attorneys will try to settle the claims made against their client in the most “economical” method possible.

In sum, understand from this article the dynamics of who is really suing you.

In sum, just be careful when dealing with any of these movie company lawsuits.  I have written about Kerry Culpepper of Culpepper IP many times, and I have even called him an “evil genius” at times because he thinks out of the box.

Chances are that each movie lawsuit is filed by the same attorney who is filing other movie lawsuits, and because there is a “common copyright troll” between the various lawsuits, there is a mechanism for them to look up your accused IP address and check to see whether you have downloaded any of their “other clients’ copyrighted titles.”

If you as a defendant are unaware of this fact, or if you are an attorney who is purposefully blind to this fact (this is one of my big problems with “settlement factory” defense attorneys), then you expose yourself (or you expose your client) to additional claims of copyright infringement while that plaintiff attorney seeks to solicit additional money for additional titles allegedly downloaded… just after you (or your client) paid them thousands of dollars to settle the claims asserted in the lawsuit.

Obviously I am simplifying here greatly (and not all attorneys ask for additional settlements), but for what it is worth, understanding the dynamics of who is suing you and where they received your information is very important when deciding how to approach the defense of your case… especially when you seek to settle one claim of copyright infringement and that plaintiff attorney claims that you downloaded four other titles belonging to “his” clients.

    Yesterday, while researching the new Headhunter, LLC North Carolina bittorrent-based copyright infringement cases, I checked back on Carl Crowell’s  RIGHTSENFORCEMENT.com website looking for movies which will be lawsuits to look to see whether “A Family Man (2016)” belonged to Crowell’s “common troll” entity, and I was surprised to see that  a whole slew of new movies are now listed on their “client” list. I suspect that these are movies which will be lawsuits in the near future.

    What does this mean to an internet user who has downloaded or streamed this movie using bittorrent, Popcorntime, and/or some other “free” streaming service?

    What this means is that they are hard at work contacting production companies / copyright holders for newer movies (a.k.a., “floppers) which have not done so well in the theaters.  They convince these companies to license the rights to “enforce” that movie company’s copyrights (think, sue in a “copyright troll” lawsuit looking for settlements).  Then they have their local counsel file “John Doe” lawsuits in select federal courts (where the judges are friendly to them, or where the lawsuits are otherwise profitable).

    What will happen to me if I have been caught downloading one of these films?

    Honestly, at the moment, likely nothing, at least not yet.  There are two ways that Carl Crowell and his team of local attorneys across the US have been enforcing their client’s copyrights.

    1. By sending a DMCA notice directly to the accused downloader through the ISP.  Here, the DMCA notice directs the accused downloader to visit the Rightsenforcement.com website, and pay a settlement for each title allegedly downloaded or streamed using bittorrent, Popcorntime, and (yes, I have heard about this too, but I do not yet understand the mechanics of it), KODI on an Amazon Fire TV Stick.
    2. By filing a copyright infringement lawsuit for $150,000 statutory damages against a set of “John Doe” defendants who were each accused of uploading and/or downloading a particular movie using bittorrent (or an app like Popcorntime which still uses bittorrent to stream movies to its users).

    What is the relevance that this list of movies is changing?

    The fact that the list of movies is changing means that there are now new copyright holder production companies who have “signed on” to the business model of copyright trolling.  Politics and policy aside, this means that the copyrights on these movies (and the infringement, or the illegal downloading, uploading, duplication, and/or streaming of these movies without a license) will be the subject of future lawsuits.

    If you look lower down on the RIGHTSENFORCEMENT.COM client list, you will see titles such as “Dallas Buyers Club,” “Mr. Church,” “The Cobbler,” “Cell,” “Fathers and Daughters,” “I.T.,” “Mechanic: Resurrection,” “Septembers of Shiraz,” “Survivor,” “Automata,” “London Has Fallen,” “Criminal,” “Eliminators,” and more recently, “Undisputed 4,” and “A Family Man.”  Each of these movies have been (and continue to be) the subjects of copyright infringement lawsuits across the federal courts in the U.S.

    Expect these new movies to be subjects of coming lawsuits as well.

    RightsEnforcement.com (Carl Crowell and his ilk) have been quiet lately as far as the DMCA notices go, but the movie lawsuits press on. Now they have NEW MOVIE TITLES that they will be suing on in the coming weeks and months.  It is worth mentioning that since I began writing about RIGHTSENFORCEMENT (I have to put their name in caps since it just looks awkward when writing it out), the company got quiet — not because of me or anything I wrote on the topic — but now I understand that they were spending their time continuing the Voltage Pictures business model and obtaining new contracts with new movie companies with the intent of ‘enforcing’ or suing John Doe Defendants who download those films (and as always, recruiting new ISPs to send their DMCA notices, whether by force or by ‘carrot and stick’).

    JULY, 2017 –UPDATE– : Carl Crowell’s Rights Enforcement client list is growing.  New RightsEnforcement Movie Clients for Future Copyright Lawsuits as of July, 2017 have now been posted here.

    How I understand this works (source: Dallas Buyers Club lawsuit against copyright trolls Voltage Pictures, Inc., a.k.a., Dallas Buyers Club, LLC).  A common troll entity (e.g., Voltage Pictures, Guardaley, MPAA, whoever) contacts the production company for some failed movie that did not make expected profits in the theater.  They license the rights to enforce the copyright owned by that movie company.  This “common troll” entity would then set up shell entities masquerading as the movie company.  These shell entities are LIMITED LIABILITY COMPANIES, which means that if there is a lawsuit against them, or if they get hit for damages, the damages are limited to the limited liability company itself, and not the criminals ‘behind the veil’ of these companies.

    This shell entity files multiple “John Doe” lawsuits across the US using German Company Guardaley (and it’s US shell company counterparts) to provide “expert evidence” that copyright infringement happened via the bittorrent networks.  They ask the federal judges to unmask the identities of the ISP subscribers who were assigned the IP address which was involved in the bittorrent lawsuit, and they contact that defendant and ask for a multi-thousand dollar settlement for the ‘loss’ they suffered because of their download.

    What movies will this ‘common troll’ sue for in the future?

    Are these famous actors or producers involved in the copyright trolling scheme?

    Likely not.  It has become apparent that the actors in the movie have absolutely nothing to do with RIGHTSENFORCEMENT, or the copyright trolling that the production company has chosen as their alternate path to making money from the film (their primary method of selling movie tickets flopped).  In fact, the actors are usually the victims of both the piracy and the lawsuit, as they benefit from NEITHER.

    Is Carl Crowell (the figurehead of RIGHTSENFORCEMENT) behind these lawsuits?

    Again, likely not.  It is also now apparent that Carl Crowell alone (the ‘owner’ of RIGHTSENFORCEMENT and the RIGHTSENFORCEMENT.com website) is likely not the businessman / entrepreneur behind the acquisition of the movie titles.  Rather, he and his RIGHTSENFORCEMENT company are most logically patsy figureheads, as was Keith Lipscomb and his now defunct law firm.  (On a side note, after all the years we thought that Lipscomb was the villain for the Malibu website, I wonder if he feels like a patsy as well — used and abused by the more powerful copyright trolls, or did Lipscomb make out with windfall profits?  It would be interesting to speak to him and have him give his side of the story to ‘spill the guts’ of who these guys behind the RIGHTSENFORCEMENT company and actually are.)

    So as much as that was ‘tongue in cheek’ (cliche which has a different meaning if you knew anything about the Malibu lawsuits Lipscomb was filing), realistically Lipscomb is bound by a number of strong contracts where he could probably lose his law license for breach of attorney-client privilege if he disclosed the identity of his ‘client’ — the one who has been filing all of these lawsuits.

    If not him, then who? (think, “who stole the cookie from the cookie jar?”)

    We don’t need Lipscomb to see who is actually behind these lawsuits.  It is becoming apparent (at least in my observation) that the entity behind Carl Crowell’s RIGHTSENFORCEMENT organization is none other than the MOTION PICTURE ASSOCIATION OF AMERICA (MPAA) and their lobbyists.

    I laugh at myself whenever I say this out loud because the idea that such an apparent ‘legitimate’ organization would engage in such banal legal tactics to monetize their copyrights to compensate for having made failed movies (“floppers”) in the theaters makes me just shake my head in disgust.  Then, having learned over the last two years that the same organization is affiliated with OR HAS DIRECTED the pornography lawsuits across the US since 2012 just makes me cringe.  “It is just too horrible.”

    Why I believe the MPAA/RIAA are behind the movie lawsuits.

    I covered why I actually think the MPAA and RIAA are behind the movie lawsuits in depth here, but I’ll quickly recap.

    Look at the evidence.  The RIAA (a similar but very related organization) was involved in so many lawsuits prior to 2010.  They sued and sued, and then all of a sudden in 2010, they went SILENT.  The MPAA also sued, my best understanding is using Voltage Pictures, and a bunch of other companies with The Expendables lawsuits, etc., all using the law firm Dunlap Grubb, & Weaver, LLC to file their lawsuit.  When those mass bittorrent lawsuits failed, it appears to me (based on the fact that the same Guardaley company was involved in both the movie AND porn lawsuits) that the MPAA and RIAA then encouraged the pornography industry to file lawsuits on their behalf to make headway in the court system to change or break copyright.

    I know I wrote “break” copyright, but I have had some time to think about it, and while I am still befuddled by the thought that the MPAA would scheme to have the porn companies file lawsuits for their own benefit to change copyright law, I wonder if they did so because they wanted to create change in the courts because they couldn’t get it done in an ineffective lame Congress.

    Anyway, this is still a mystery to me, and it is bigger than me, and I am not the one with authority or power to break the story, expose the MPAA, or investigate the MPAA or the RIAA with any credibility other than my best guesses based on what I see come out in the lawsuit filings and disclosures.  It simply must be noted that with the exodus of Lipscomb from the adult film lawsuits and the merging of the RIAA (now embodied in Rightscorp) and the MPAA (with the movie titles) all coming together in Carl Crowell’s RIGHTSENFORCEMENT entity (which is growing in power and in licenses to movie production companies who have signed on with them), I must assume legitimately that there must be a REASON why these movie companies are obediently ‘falling in line’ and signing up with Crowell’s organization.  That reason cannot be that there are so many greedy movie production companies in Hollywood who have all of a sudden embraced copyright trolling as a legitimate copyright monetization business strategy. Rather, I believe that reason is that THE RIGHTSENFORCEMENT ORGANIZATION AND ITS MOVIE COMPANY CONTRACT DOES NOT BELONG TO CARL CROWELL, BUT TO THE MPAA/RIAA ENTITIES.

    RIGHTS ENFORCEMENT Sending DMCA Letters for Porn

    CEG-TEK-DMCA-Scare-Letters

    In June, 2014, I exposed the list of porn companies that were working with CEG-TEK.  This upset a lot of adult film companies, who turned around and started having CEG-TEK send letters using a variation on their name (which made no sense to me *IF* the reason they were having CEG-TEK send out DMCA notices was to “encourage ‘pirates’ to sign into their websites legitimately and pay an annual fee”).  Instead, like roaches, these companies scattered, but even so, I still tracked the name changes and I kept this list up to date.

    The reason this list is immediately relevant is because now Carl Crowell is sending out these same DMCA notices to Internet Subscribers through his RIGHTS ENFORCEMENT company.  For more about Crowell or his RIGHTSENFORCEMENT.COM website, click this link.

    Below is a list I compiled from my own records as to which copyright holders are hiring companies to collect $300 per title settlements on their adult film copyrights.  The exciting news from 2017 is that I now have an idea of what are the porn companies which are now working aggressively with Carl Crowell (RIGHTS ENFORCEMENT), including some which were not working with CEG-TEK.  I will list the most active companies first.

    REALITY KINGS (Manwin Content)

    Reality Kings (http://www.realitykings.com).  Reality Kings has obscured their name in the past after I posted the original list in 2014.  They have been known to send out DMCA letters using the names 1) Manwin Content RK Limited DBA Reality Kings, and 2) MG Content RK Limited.  Regardless of the name, it is still Reality Kings.

    Reality Kings is a giant corporation, comprising 45+ separated brand names, each of which have their own website.  Their brand names include:

    Brazzers is another a giant corporation, comprising 47+ separated brand names, each of which have their own website.  Their brand names include:

    Now obviously you will notice a common theme along each of these copyright holders, and that is the “genre” of content they all produce. You will also notice that in this list there are “copyright trolls,” (meaning, companies who in the past have used or use the federal courts to sue individual downloaders for copyright infringement) and there are “not” copyright trolls (meaning, companies who have NOT sued defendants for copyright infringement). You can see which are copyright trolls by either searching the web for their name, or doing a search on PACER or JUSTIA to see whether they have sued in federal court.

    A few things to note.

    1) Many of the larger companies have multiple websites, and do business as multiple entities. For example, Froytal Services Ltd. “does business as” (“DBA”) Mofos and Brazzers (corresponding to their Mofos.com and Brazzers.com websites).

    2) Many copyright holders are OLDER COMPANIES and FAMILY OPERATED BUSINESSES. This means that it is common to have former porn companies hire CEG TEK to track and send letters for “vintage” films from the 1970’s and 1980’s. The copyrights for these films ARE STILL IN EFFECT, and the former owners of those companies are now elder individuals who are now enforcing their copyrights from FORTY YEARS AGO. On the flip side, many older couples have been caught downloading a film from their youth thinking that since the titles were so old, it was probably legal to do so.

    In sum, all I ask of everyone is to understand that the bittorrent networks are no longer safe, and when you download something, assume someone else is watching you. And, be aware that there are companies out there like RIGHTS ENFORCEMENT who are lurking in the bittorrent swarms waiting for you to click on a link so that they can send you a settlement demand letter.

      Why I Believe MPAA/RIAA in a Scheme to Break Copyright Law

      Analyzing the relationship between MPAA/RIAA and the adult film industry lawsuits (via Guardaley).

      Yesterday, I spent most of the day writing articles for the blog.  My two priorities for the day were 1) to get articles out on RIGHTS ENFORCEMENT (focusing on how they differ from what I wrote about CEG-TEK), and 2) to write about the great merging of the porn and movie industry to break copyright law.

      THE RIGHTS ENFORCEMENT ARTICLES FOCUSED ON HOW THEY DIFFER FROM CEG-TEK.

      Getting articles out on RIGHTS ENFORCEMENT was my first priority, specifically, because so many people were going to the old CEG-TEK articles, and I did not want to give my readers a false sense of security based on what I wrote about those same topics as they applied to the CEG-TEK entity.

      RIGHTS ENFORCEMENT should be considered a hostile copyright troll (analogous to a John Steele / Prenda-level troll because their beliefs about law and ‘pirates’ mirror each other).  I have abstained from commenting on the personality of Carl Crowell (the owner of RIGHTS ENFORCEMENT and the likely puppet master behind all of the adult film and movie “John Doe” bittorrent lawsuits filed across the US).  However, I meant it when I said that one should expect tactics of using very illegal, but untraceable means to violate the security of your computer when you log into his site in order to gain leverage over you and scare you into paying a settlement.

      Why do I think Crowell would break the law just as John Steele did to achieve his goals?  Attorneys that powerful (if not already corrupt) become corrupted, and I have too often seen them develop a sense of invincibility to the law.  After crossing one grey line after another, they ultimately end up breaking the law thinking that they will never be caught.  This is what happened to John Steele, and this is what I am guessing will eventually happen to the Carl Crowell.

      HERE IS WHAT I KNOW ABOUT THE RIGHTS ENFORCEMENT CASES.  ALL ARTICLES POSTED WERE OFFSHOOTS OF TOPICS FROM THIS ARTICLE.

      You should expect that RIGHTS ENFORCEMENT will likely be treating cases differently than CEG-TEK did, so I did not want people to get the wrong impression that they were harmless, as CEG-TEK was (in comparison).

      WHY I NOW BELIEVE THAT THE MPAA/RIAA COLLUDED WITH THE PORN COMPANIES TO CREATE CASE LAW IN ORDER TO BREAK COPYRIGHT LAW.

      The more important topic I wrote about yesterday got shadowed by my other articles.  That topic was how the MPAA/RIAA appears to have colluded with the adult film / porn companies with the intent of breaking copyright law.

      HERE IS WHY I THINK THAT THE MPAA/RIAA IS BEHIND THE ADULT FILM LAWSUITS WE HAVE SEEN OVER THE LAST SEVEN YEARS.

      I started the Cashman Law Firm, PLLC in 2010, just as the MPAA/RIAA lawsuits became quiet. I always wondered where they went, and why they stopped suing defendants.

      Now based upon the explicit ‘coming together’ of the adult film companies, the movie companies (MPAA), and now Rightscorp (RIAA) under the leadership of Carl Crowell, his network of attorneys filing Guardaley-backed bittorrent lawsuits across the US, and now the appearance of his RIGHTS ENFORCEMENT company, the merging of what were thought to be separate entities demonstrates that perhaps they weren’t so separate as we thought they were.

      WHY I THINK THAT THE MOVIE INDUSTRY AND THE PORN INDUSTRY WERE IN COLLUSION

      With the appearance of the RIGHTS ENFORCEMENT entity, I couldn’t help but to think that 1) EITHER CARL CROWELL IS A GENIUS ATTORNEY WHO HAS MERGED THE TWO VERY SEPARATE FACTIONS — MOVIE-BASED COPYRIGHT TROLLS, and PORNOGRAPHY-BASED COPYRIGHT TROLLS, or 2) CARL CROWELL IS MERELY A FIGUREHEAD, A PATSY.

      Reading what I have learned about this man, I cannot believe that he is a genius who has united the separate entities of movie lawsuits and porn lawsuits.  This is just too big of a project for one man.  Rather, I think Carl Crowell is the figurehead replaced by some entity behind the scenes when the relationship between this Guardaley-backed ‘investor’ and Keith Lipscomb soured in April of 2016.

      REMEMBER — WHEN LIPSCOMB AND MALIBU MEDIA LLC PARTED WAYS, LIPSCOMB AND GUARDALEY ALSO PARTED WAYS.  MALIBU MEDIA LLC CONTINUED FILING LAWSUITS WITH THEIR GUARDALEY-BACKED ENTITY AS THE BOSS, CLAIMING, “WE HAVE A NEW INVESTOR.”  ONLY THEN WAS CARL CROWELL INSTALLED AS THE HEAD OF THE GUARDALEY-BACKED SET OF LAWSUITS.

      Thus, it occurred to me that Carl Crowell is not the one behind everything, but he is merely their “figurehead / fall guy” answering to some higher entity (just as Lipscomb was the “figurehead / fall guy” to some higher entity for all of the porn-based lawsuits filed since 2010, and just as Paul Duffy of Prenda Law Inc. (R.I.P.) was the “figurehead / fall guy” installed by John Steele).  [It would be interesting to learn whether John Steele TOO answered to some higher entity, because he too fits the profile I am about to describe.]  Each of these guys came out of nowhere into positions of extreme power, and with the exception of Lipscomb, each of these guys reminded me of drunk fraternity guys who showed up to work in a stretched and torn football jersey, shorts, and a hangover.

      HOW I ARRIVED AT THE CONCLUSION THAT THE MOVIE AND PORN INDUSTRY ARE WORKING TOGETHER TO BREAK COPYRIGHT LAW

      In the context of researching the ME2 cases (already noting that there was a connection between a number of movie cases [ME2/COOK/CELL/SEPTEMBER/I.T.], specifically, that the same attorneys were filing the same set of lawsuits across the US), I wrote a side article explaining “the evolution of piracy,” (an innocuous post).  In that post, it occurred to me that “it would be just too terrible” if there was collusion between the movie industry and the porn industry.

      A few days later, I noticed in my website’s analytics that people were rushing to view my CEG-TEK articles, and I could not figure out why (CEG-TEK was no longer sending out letter to John Doe Defendants).  From there, I learned about Carl Crowell (who I previously ignored as being a nobody) and his RIGHTS ENFORCEMENT entity, which demonstrated that there was a connection between the movie industry and the porn industry.

      It was then when I saw that Carl Crowell’s RIGHTS ENFORCEMENT entity represented both the mainstream movie companies (the ME2 / COOK PRODUCTIONS / I.T. PRODUCTIONS connection I was already looking for), and from my own website analytics and follow-up research, learning that RIGHTS ENFORCEMENT was also sending out notices for CEG-TEK’s old porn company clients that I made the connection that perhaps there was a relationship between the porn and movie industry.

      Then I remembered the Guardaley connection years back when representing clients in the Dallas Buyers Club, LLC cases, and it occurred to me that some entity connected with Guardaley is behind both the porn-based lawsuits AND the movie-based lawsuits, but why?  That is where I learned that Rightscorp (the MPAA/RIAA also joined with Carl Crowell), and the connection made sense.  Through some common entity or ‘investor’, both the movie companies and the adult film companies are having their lawsuits funded.  Then it occurred to me how convenient it would have been for that investor to be the MPAA/RIAA, especially considering the millions they are pouring into Rightscorp (a sinking ship), just as they spent [I believe] hundreds of millions on lawsuits for copyright infringement shortly before I started my Cashman Law Firm, PLLC in 2010.

      I always wondered why all of a sudden in 2010, the MPAA/RIAA stopped filing the copyright infringement lawsuits.  Now, I am starting to understand that if I am correct about the MPAA/RIAA being the entity behind the adult film lawsuits, they never did stop their activities.  Rather, they just devised a clever scheme to get the porn industry to file lawsuits and blaze the trail to create case law across the US (because most pornography-based defendants do not fight back, and judges laugh when they see the explicit porn titles sued upon, and through this uncomfortable laugh, judges undermine their legal sense and allow the ‘repressed, stigma-based industry’ to proceed with protecting their rights to sue “just like everyone else.”).  As a result of having the porn companies file the lawsuits across the US, IF what is unfolding ends up being true, then the MPAA/RIAA schemed to break copyright infringement law so that they can come back seven years later and start filing lawsuits, but now, with a “lower bar” and relaxed legal standards.
